Welcome to NewKing AI! These Terms of Service ("Terms") govern your access to and use of our AI chatbot services, websites, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. BY USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY.

1. Age Requirements

You must be at least 13 years old to use our Services. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the Services, you represent that you meet these age requirements. We reserve the right to terminate accounts of users who do not meet these requirements.

2. Your Use of the Services

• Technical failures or security incidents.

3. Subscriptions and Payments

3.1 Subscription Plans

We offer various subscription plans with different features and pricing. Details of available plans are provided on our pricing page. Free tier users may have limited access to certain features.

3.2 Billing

Paid subscriptions can be selected on a monthly or annual basis according to the plans shown on the pricing page. Subscriptions do not automatically renew.

3.3 Refund and Cancellation Policy

• Payment cancellation is only available within 1 hour(s) after payment completion and only if the chatbot service has not been used.
• A full refund will be issued if the above conditions are met.
• Refunds are not available if more than 1 hour(s) has passed since payment completion or if the chatbot service has been used at least once.
• When withdrawing membership through 'My Profile > Account Withdrawal', no refund will be issued for the remaining subscription period.
• Refund processing may take 3-5 business days depending on the payment method.
• When canceling a PayPal payment, exchange/withdrawal transaction fees (approx. 2.0%) are non-refundable.

4. User Content

You retain ownership of any content you submit through the Services ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and transmit your content solely for the purpose of providing and improving the Services.

You are solely responsible for your User Content and represent that you have all necessary rights to submit it. We are not responsible for any User Content submitted by you or other users.

4.1 Uploaded Document Copyright

Document Upload Copyright: You are solely responsible for the copyright and legality of documents (PDF, Word, etc.) uploaded to the document search service. The Company is not liable for any legal consequences arising from the upload of unauthorized copyrighted materials.

Document Visibility Settings: Users can select the visibility scope when uploading documents:

• Private: Only you can search
• Group Shared: Only members of the designated group can search
• Public: All users can search

Users must carefully select the visibility scope when uploading documents, and are responsible for any consequences arising from their visibility settings.

5. Intellectual Property

The Services, including all content, features, and functionality (excluding User Content), are owned by NewKing and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

6. AI-Generated Content and Image Generation

Our Services may include AI-generated text and, in the future, AI-generated images. Regarding such content:

• AI-generated content is provided "AS IS" without any warranty of accuracy, completeness, or fitness for a particular purpose.
• You are responsible for reviewing and verifying AI-generated content before use.
• You may not use AI-generated content to create misleading or deceptive materials.
• For AI-generated images, you are responsible for ensuring your use complies with applicable laws, including laws regarding intellectual property, privacy, and prohibited content.
• We reserve the right to restrict or terminate access if AI-generated content is used in violation of these Terms or our Usage Guidelines.

7. Third-Party AI API Disclaimer

Our Services utilize artificial intelligence APIs provided by third parties including OpenAI, Google (Gemini), and Anthropic (Claude). You acknowledge and agree that:

• We do not warrant the accuracy, reliability, or completeness of responses generated by third-party AI APIs.
• Third-party AI providers may have their own terms of service and usage policies that apply to content generated through their APIs.
• We are not responsible for service interruptions, failures, or quality issues caused by third-party AI providers.
• Changes to third-party AI providers' terms, policies, or pricing may affect the availability or functionality of our Services.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Seoul, Republic of Korea.

For users in the United States, you agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
